This Privacy Policy explains what personal data The Recruitment Compass LLC collects, why, and how we protect it. If you are a resident of the EU, EEA, UK, or California, you have additional rights described in Sections 4 and 8.

  • Submitting required documentation to U.S. and Canadian government authorities on your behalf
  • Processing and recording payments through our official payment portal
  • Sending program updates, Aftercare materials, and pre-departure communications
  • Responding to enquiries submitted through our contact form or email
  • Improving our website experience through anonymized analytics
  • Complying with applicable legal and regulatory obligations

We do not sell, rent, or trade your personal data to any third party for marketing purposes.

Legal Basis for Processing (GDPR)

For users in the EU, EEA, or UK, TRC processes your personal data under the following legal bases as defined by the General Data Protection Regulation (GDPR):

  • Contract performance — Processing necessary to fulfill your application and placement agreement
  • Legal obligation — Processing required to comply with immigration law and government reporting requirements
  • Legitimate interests — Improving our services, preventing fraud, and securing our platform
  • Consent — For optional communications such as newsletters or survey participation, where you have explicitly opted in

How We Share Your Data

TRC shares personal data only when necessary and with appropriate safeguards in place. Recipients include:

  • Employer clients — Limited candidate profile information shared during the matching and onboarding process
  • U.S. government authorities — USCIS, Department of Labor, U.S. Embassy/consulates as required for visa petitions
  • Canadian government authorities — Immigration, Refugees and Citizenship Canada (IRCC) as required for SAWP permits
  • External partner agencies — Where you applied through a TRC partner, that partner receives confirmation of placement status only
  • Payment processors — Your payment is handled by a third-party PCI-compliant processor. TRC does not store payment card data
  • Squarespace (site platform) — Our website hosting provider may collect technical data as described in Squarespace's Privacy Policy

We do not share your data with any other third parties without your explicit consent.

Cookies & Tracking

Our Site uses cookies and similar technologies. For full details of the cookies we use and how to manage them, please see our Cookie Policy.

In summary, we use:

  • Essential cookies — Required for the Site to function. Cannot be disabled.

Data Retention

TRC retains your personal data only for as long as necessary to fulfill the purposes for which it was collected:

  • Active applicants and placed candidates: Retained throughout the program period and for 5 years following placement, to comply with immigration recordkeeping requirements
  • Unsuccessful or withdrawn applicants: Retained for 2 years for legal documentation and no-rehire record purposes
  • Payment records: Retained for 7 years in accordance with U.S. tax and financial recordkeeping law
  • Website analytics data: Anonymized and retained per Squarespace's data retention schedule

After the applicable retention period, your data is securely deleted or anonymized.

Section 8
Your Rights

Depending on your location, you may have the following rights regarding your personal data:

  • Right of access — Request a copy of the personal data TRC holds about you
  • Right to rectification — Request correction of inaccurate or incomplete data
  • Right to erasure — Request deletion of your data (subject to our legal retention obligations)
  • Right to restrict processing — Request that we limit how we use your data
  • Right to data portability — Request your data in a portable format (EU/UK residents)
  • Right to object — Object to processing based on legitimate interests
  • Right to withdraw consent — Withdraw consent at any time for consent-based processing
  • CCPA rights (California residents) — Right to know, right to delete, right to opt-out of sale (note: TRC does not sell personal data)

Section 9
Children's Privacy

TRC's services are intended for individuals aged 18 and over. We do not knowingly collect personal data from anyone under the age of 18. If you believe we have inadvertently collected data from a minor, please contact us immediately at director@therecruitmentcompass.com and we will delete it promptly.

Section 10
International Transfers

TRC operates from the United States and processes data in the U.S. If you are located in the EU, EEA, UK, or another jurisdiction with data transfer restrictions, your data may be transferred to and processed in the U.S. Where such transfers occur, we rely on standard contractual clauses or other appropriate safeguards recognized under applicable data protection law.

Data shared with U.S. and Canadian government authorities is transferred as required by law and cannot be subject to standard commercial data transfer agreements.

Data Security

TRC implements appropriate technical and organizational measures to protect your personal data against unauthorized access, disclosure, alteration, or destruction. These measures include:

  • Secure HTTPS encryption across the entire Site
  • Access controls limiting data access to authorized TRC personnel only
  • Third-party payment processing handled by PCI DSS-compliant providers

TRC may update this Privacy Policy periodically to reflect changes in our practices or applicable law. We will post the updated policy on this page with a revised effective date. For material changes, we will notify active applicants by email. Your continued use of our Site or services after any update constitutes acceptance of the revised policy.
